Welcome to MushAI (“App”, “we”, “our”, or “us”).

By downloading, accessing, or using MushAI, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the App.

1. About MushAI

MushAI is an AI-powered mushroom and fungi identification application designed for learning, discovery and educational use.

The app allows users to take or upload photos of mushrooms and fungi and receive AI-generated identification results and related information.

MushAI uses a custom-trained artificial intelligence model built on a database of over 3 million mushroom and fungi species.

2. Educational Purpose Only

MushAI is provided strictly for educational and informational purposes.

The results, suggestions, names, and information provided by the App:

• do not constitute professional, medical, biological, or foraging advice

• should not be relied upon for deciding whether a mushroom is safe to touch, handle, cook, or consume

You must always consult a qualified expert or professional mycologist before consuming or handling any wild mushroom.

We do not guarantee that any identification result is correct, complete, or safe for real-world use.

3. No Liability for Foraging or Consumption

You acknowledge and agree that:

• mushroom identification is inherently complex and prone to error

• visually similar species may be toxic or dangerous

MushAI and its creators are not responsible for any injury, illness, loss, damage, or harm resulting from:

• reliance on identification results

• foraging activities

• consumption of any mushroom or fungi

You use MushAI entirely at your own risk.

4. AI Results and Limitations

MushAI uses automated image analysis and machine learning systems to generate identification suggestions.

AI results:

• may be inaccurate, incomplete, or misleading

• depend on photo quality, lighting, angle, and environmental conditions

• should always be verified by a qualified expert

We make no guarantees regarding accuracy, reliability, or fitness for any particular purpose.

5. User Content (Photos and Notes) and 3rd party processing

You retain ownership of any photos, images, and notes you submit to the App.

By using MushAI, you grant us a limited, non-exclusive, non-transferable license to process your submitted images solely for the purpose of providing identification and app functionality.

Once consent for data sharing is given, images will be sent to a third-party AI service for processing

When you submit an image for identification, the image is securely sent to trusted third-party AI providers, including OpenAI and Anthropic (provider of the Claude models), together with our own custom mushroom reference datasets. The image is used strictly for the purpose of identifying the mushroom and generating the result shown to you, and is not used for any other feature or purpose.

All images are processed in an anonymized manner and are not linked to your account or personal identity by these providers. The third-party services do not use your images for training their models, and the images are deleted after processing in accordance with their data-handling policies. Any other data generated in the app — including your scan history, previous identifications, and stored photos — remains on your device and is not transmitted to our servers or to third-party services.

6. Privacy

Your photos remain on your device unless you explicitly choose to share them.

Our collection and use of personal data is governed by our Privacy Policy.

7. Subscriptions and Payments

All payments, subscriptions, free trials, renewals, and cancellations are handled exclusively through the Apple App Store.

MushAI does not directly process or store your payment information.

You can manage your subscriptions and billing through your Apple account settings.

8. Free Trials and Auto-Renewal

If MushAI offers a free trial or subscription:

• payment will be charged to your Apple ID at confirmation of purchase

• subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

• your account will be charged for renewal within 24 hours prior to the end of the current period

You are solely responsible for managing and cancelling your subscription.

9. Intellectual Property

All content provided in MushAI, including but not limited to:

• app design

• logos

• interface

• AI models

• text and educational material

are owned by or licensed to MushAI and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or exploit any part of the App without prior written permission.

10. Acceptable Use

You agree not to:

• misuse the App

• attempt to interfere with its infrastructure or security

• use the App for unlawful purposes

• attempt to extract, scrape, or replicate the underlying AI systems or datasets.

11. Service Availability

We may modify, suspend, or discontinue any part of MushAI at any time, with or without notice.

We do not guarantee uninterrupted or error-free operation of the App.

12. Termination

We reserve the right to suspend or terminate your access to MushAI if you violate these Terms or use the App in a way that could harm users, systems, or the service.

13. Disclaimer of Warranties

MushAI is provided “as is” and “as available”.

We expressly disclaim all warranties of any kind, including implied warranties of:

• accuracy

• reliability

• merchantability

• fitness for a particular purpose

14. Limitation of Liability

To the maximum extent permitted by law, MushAI and its owners, developers, and partners shall not be liable for any indirect, incidental, special, consequential, or personal injury damages arising from:

• your use of the App

• reliance on identification results

• any foraging or consumption decisions

15. Changes to These Terms

We may update these Terms from time to time.

Continued use of MushAI after changes are published constitutes your acceptance of the updated Terms.
